Confusion continues to surround the topic of worker classification. As the Dept. of Labor (DOL) prepares to issue a final rule, Congress held hearings to allow for discussion and comments. One former DOL official, Tammy D. McCutchen, called for the development of “a single, clear and simple” rule for classifying workers. In her testimony she pointed out that the IRS, the DOL and the states all have their own rules. “Employees are best protected when they understand what the law requires,” she stated, adding that employers want to comply, if they understand the law. The current law is too complicated, she concluded, supporting her call for one single, clear and simple rule.
